Don't Demoralize the Armed Forces: Supreme Court Rejects Plea for Judicial Probe into Pahalgam Terror Attack

The Supreme Court sharply criticized the petitioners who sought a judicial inquiry—headed by a retired judge—into the Pahalgam terrorist attack, ultimately dismissing the plea. The Court emphasized the need to understand the prevailing national circumstances and the sensitivity surrounding such issues. "One must consider the implications before filing such petitions. Petitions that can demoralize the armed forces should not be entertained," the bench observed.

The Court further noted that filing Public Interest Litigations (PILs) in such sensitive matters demands a higher level of responsibility. “You too have a duty towards the nation. This is a crucial time when every Indian must unite in the fight against terrorism,” Justice Surya Kant told the petitioners. The bench comprised Justices Surya Kant and N. Kotiswar Singh.

Questioning the credibility of the requested investigation, the Court remarked, “You are seeking an inquiry led by a retired Supreme Court judge. Since when did retired High Court or Supreme Court judges become experts in such investigations?” The Court stressed that it must deliver rulings based on legal disputes, not speculative or sensitive matters that risk damaging national morale.

Terming the petition unacceptable, the Court reiterated that no application that could undermine the morale of the armed forces should be allowed at this critical juncture. Following the stern rebuke, the petitioners withdrew their plea.
